1. Contract Formation
By completing a purchase on our website, you agree to be bound by these Terms & Conditions. Please ensure you read and understand these terms before making a purchase.
2. Governing Law and Jurisdiction
These Terms & Conditions are governed by the laws of New South Wales, Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of New South Wales.
3. Consumer Guarantees Preservation Clause
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), which cannot be excluded by contract.
4. Warranties
Wadorth provides voluntary warranties that are in addition to your rights under the Australian Consumer Law. These warranties do not exclude or limit your rights under the consumer guarantees provided by the ACL.
5. Limitation of Liability
Our liability is limited to the extent permitted by law. We do not exclude or limit our liability for any major failure under the Australian Consumer Law.
6. No Class Action Waiver
We do not include any provisions that would waive your right to participate in a class action. Any such terms would be void under the Australian Consumer Law's unfair contract terms regime (Part 2-3 ACL).
7. Intellectual Property
All content on the Wadorth website, including but not limited to text, graphics, logos, and images, is the property of Wadorth or its content suppliers and is protected by Australian and international copyright laws.
8. User Obligations
Users of our website agree not to engage in fraudulent activities, scrape data, or resell products without our express authorisation. Any breach of these obligations may result in termination of access to our services.
9. Pricing and GST
All prices displayed on our website are in Australian Dollars (AUD). Wadorth is not currently registered for GST; no GST is added to or collected on sales.
10. Payments
We accept payments via Shopify Payments and Shop Pay. By providing your payment information, you authorise Wadorth to charge the total order amount to your selected payment method.
11. Dispute Resolution
If you have a complaint, please contact us first via our Complaint Handling page. If the issue is not resolved, you may escalate the matter to the ACCC or your state fair-trading office.
12. Modifications, Severability, Termination
We reserve the right to modify these Terms & Conditions at any time. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in effect. We may terminate your access to our services if you breach these terms.
